Terms & Conditions

Family Splash Agreement and Terms and conditions. Please read, and familiarise yourself with the terms and conditions. Covid- 19 Precautions – Please ensure that you antibac you hands before and after leaving the pool area, there is hand sanitiser situated on the wall in the entrance and changing rooms.

Please arrive ready to get into the pool where possible and no earlier than 10 minutes prior to your session time and only bring in anything that is essential for your swim, please refrain from bringing handbags, coats etc. You will be allocated 15 minutes to get changed after your swim and we would ask that you adhere to this as we have to clean and sanitse the changing rooms after each use before any other family can access them. Please note that the showers are currently closed.

We ask that you do not attend if you are displaying any symptoms or have been in contact with anyone who is symptomatic of covid-19 or who has tested positive. You must take home with you any rubbish or nappies from your session. Refund and cancellations – Happy Splash are under no obligation to refund or transfer your money if you are unable to attend your allocated swim session, we regret that we are unable to offer an alternative for missed sessions. In the instance that the pool cannot be used in the short term, we will rearrange your session.

Where the pool is not available for a length of time (in excess of 1 week) on public health or other grounds outside of our control (not including operational issues with the pool). If this occurs and, in the event, that we are unable to reschedule the sessions, we will give a full refund via your original payment method. Adverse Weather – Happy Splash is under no obligation to refund lessons that may have been missed due to local adverse weather conditions. Valuables and Jewelry – All property left in changing rooms or on the poolside and all property (including push chairs) left outside is left at your own risk. Happy Splash cannot accept any responsibility for the loss or damage of any personal possessions. Please remove all jewellery (except wedding rings) before entering the water.

Illness – Should your child or the adult taking your child into the water have or develop any known suspected medical conditions, you must please consult your doctor before bringing them swimming and inform our office either via the bottom section of this form or if at a later date diagnosed in writing via email or post. All information received is treated with the upmost confidence and with sensitivity. Never bring you child swimming if they have any illness such as an ear infection, vomiting and or diarrhea, chicken pox, impetigo, conjunctivitis or a bad cold. Please wait until your doctor has given all clear before returning to classes. In the instance of vomiting and or diarrhea all swimmers must have been clear of all symptoms for at least 48 hours before attending a session. Our lifeguard may refuse entry to the pool if they reasonably believe that any swimmer is not well enough to participate in the lesson. Nappies and Baby changing – All babies and toddlers who have not been toilet trained must wear our double nappy system. This is either a reusable cotton nappy or a disposable paper swim nappy with a Happy Nappy or Neo Nappy on top. Children who have been toilet trained do not need to wear a nappy however we would advise that they are taken to the toilet prior to entering the swimming pool.

We reserve the right to refuse entry to any child who is not suitably attired. Babies wearing any other attire including wetsuits or warmers must still wear the double nappy system. We have E changers that are available to use, and they are on the wall in both the male and the female changing rooms. You are not to leave your child unattended at any time and the safety strap must always be used. These changers are used t your own risk and Happy Splash will not accept any liability or responsibility for any injuries or accidents that occur. Please take all used nappies away with you.

Withdrawal of service. – Happy Splash may at its own discretion refuse entry to a client if they feel that the client’s behavior or anyone that is associated with them behavior is unreasonable. Pool/Poolside Health and Safety – There is a maximum of 10 swimmers allowed in the pool at any one time. There must be a minimum of 1 adult to all non-competent swimming children. No outer footwear, prams or push chairs are to be taken onto the poolside or into the changing rooms. Prams, car seats or push chairs are to be left outside of the entrance to the pool and footwear is to be taken off and left in the entrance to the pool. (There are hooks for coats and places for outer footwear to be left). If you wish to keep your shoes on, then there are blue over shoe covers supplied or if you prefer you can go bare foot. Whilst you are waiting for your session to commence please stay in your allocated changing room until the lifeguard lets you know that you are safe to enter the pool.

DO NOT ENTER the pool until the current session has finished and you must always wait to be invited by your lifeguard to get into the pool. You are responsible for the safety and the supervision of your child/children at all times on poolside, in the changing rooms and on the pool premises. Children should never enter the pool without an adult. They should always be under the direct supervision of an adult and never be left unattended. Children running on wet surfaces can slip very easily and may hurt themselves. Happy Splash reserves the right to ask anyone to leave the poolside at any time. No food or drink on the poolside. No jumping in from the side of the pool.

(update 04/07/22) All swimmers must use the steps to enter and exit the pool without the use of additional medical equipment unless pre-agreed and appropriately risk assessed in advance.

(update 04/07/22) And medical equipment required for swimmers must be declared to happy splash administration team at least 7 days in advance of their session and agreed before booking a family swim session.  This is so we can ensure that our swimmers are safe during their session.

(update 04/07/22) Any use of the pool with undeclared medical equipment may be refused by the lifeguard at the time of the session and a refund will not be given.

(update 04/07/22) Any use of the pool with any unagreed medical equipment will not be covered by our insurance and is strictly forbidden.

All rubbish and nappies are to be removed and taken with you when you leave. Exclusion of liability – In the absence of any proven negligence, lack of diligence or breach of duty by the lifeguard, Happy Splash Ltd, the participation of you, your spouse/partner, child or those in whose care you have placed your child for the purpose of attending or observing Happy Splash family fun swimming sessions is done so entirely at your and their own risk. Safeguarding – Happy Splash is committed to providing good child safeguarding practice for all of our swimmers and we have adopted the ASA Safeguarding Policy – Wavepower, a copy of this is held in the Happy Splash office or can be viewed and downloaded from www.swimming.org. Happy Splash’s policy is one where we accept that good safeguarding and fair play is paramount for all our swimmers. Photographs – You can take photographs of your family when you are in the pool. However please ensure that you only take photographs of your own family and that no photographs are to be taken of any residents visible through the viewing window.

Changes to Terms and Conditions – There may be times when we will update these terms and conditions. We will either resend the updated terms and conditions or we will send you a notification of any minor changes. You are within your rights to not accept these changes. If you do not agree then we ask that you notify us in writing of you non acceptance with 14 days of your receipt. If this is not received within 14 days, we will be entitled to treat our agreement with you as being subject to the updated version.
